Terms and General Conditions

This agreement describes the Terms and General Conditions (the "Terms and General Conditions") applicable to the use of the services offered by Buscamos Personas ("Services") within the website "Buscamos Personas". Any person willing to access the website and/or use its services must abide with the Terms and General Conditions, along with all other policies and principles that rule Buscamos Personas and that are included in this agreement.
ANY PERSON NOT WILLING TO ACCEPT THESE TERMS AND GENERAL CONDITIONS, WHICH HAVE A BINDING AND COMPULSORY CHARACTER, MUST REFRAIN FROM UTILIZING THE SITE AND/OR ITS SERVICES.
Users should read, understand and accept all the conditions established in the Terms and General Conditions and in the Privacy Policies as well as in all other documents included in them.
01 - Registration
Users must fill in all fields of the registration form with valid data to be able to utilize the services offered by Buscamos Personas. Potential users must provide accurate, precise and true information and assume the responsibility to update this information if necessary. Buscamos Personas will be able to utilize several means to identify its users, but Buscamos Personas is not responsible for the accuracy of the personal data provided by its users. Users guarantee the truth, accuracy, force and authenticity of the personal data entered.
Buscamos Personas has the right to request some proof and/or additional data to corroborate the personal data, as well as to suspend temporarily or definitely those users whose data may not have been confirmed. In such cases, all the ads that have been published will be removed. By no means will users be entitled to any compensation of any kind.
Users will access their personal account ("Account") by entering their e-mail address and personal password. Users must maintain the confidentiality of their personal password in Buscamos Personas.
Users will be responsible for all operations performed in their accounts as access to them requires their password, which is of their restricted usage and knowledge. Users must notify Buscamos Personas immediately through a reliable and suitable source of any unauthorized use of their account, as well as any access by third parties without their consent.
Buscamos Personas has the right to reject any request of registration or to cancel a registration previously accepted, without being obliged to communicate or to explain the reasons of its decision. By no means will users be entitled to any compensation of any kind.
02 – Agreement Modifications
At any time, Buscamos Personas will be able to modify the Terms and General Conditions and publish the terms modified in the website. All the terms modified will become effective 10 (ten) days after their publication. Users should inform within the next 5 (five) days of publication via e-mail -by clicking here- whether they accept the modifications or not. In case they do not accept the modifications, the agreement will be void and users will be barred from the system unless they have pending debts. Once this deadline is due, the new terms will be deemed accepted and the agreement will continue being effective.
03 – Ad Publication
3.1 Users will be able to publish their ads in the chosen category. Ads may include charts, descriptive texts, or pictures provided they do not violate this agreement or other policies of Buscamos Personas. Ads must include a description of their main characteristics. In case a picture is included, it must correspond to the ad that is shown. Any ads that violate these rules will be removed by Buscamos Personas. It is explicitly agreed that the description of the ad may include personal and contact data, and that Buscamos Personas is not responsible for the accuracy of that information.
04 – Information Privacy
In order to utilize the Services offered by Buscamos Personas, users must provide personal information. This information is processed and stored in servers or magnetic media that maintain high security and physical and technological protection standards. For more information on the privacy of personal data and cases where the information will be revealed, refer to the Personal Data Protection Law No 25326.
05 - Obligations of the Ad Publishers
5.1 Buscamos Personas is a meeting point between publishers and receivers and does not participate in any way in the activities carried out by them. Publishers are responsible for the publication of their ads. By no means is Buscamos Personas entitled to any responsibility for the violation of the agreement.
Publishers agree to receive the e-mails receivers send. Buscamos Personas will not be entitled to any responsibility of any kind. At any time, ads and/or the picture or image can be edited. Bear in mind that modified ads will be on hold for two days maximum in order to verify the new information before being published.
Ads will only be considered valid once they have been processed by the data processing system of Buscamos Personas.
Buscamos Personas only provides its users with Internet connection so they can communicate their needs.
06 – Prohibitions
By no means can ads include insults, obscene words or any similar aggression that may affect third parties' name and reputation. Ads of this kind will be immediately canceled by Buscamos Personas.
07 - Sanctions. Services Suspension
Buscamos Personas will notify, temporarily suspend or definitively remove any account or publication, and it will suspend its Services in case (a) some law, any article of the Terms and General Conditions or other policy of Buscamos Personas is violated; (b) users violate their responsibilities; (c) any deceitful conducts or fraudulent acts are performed; (d) users' identity may not be verified or any information provided by them is incorrect.
In case users are suspended or barred as such, all the ads published by them will be removed from the system.
08 - Responsibility
Buscamos Personas only provides its users with Internet connection which they can use to communicate their needs. By no means is Buscamos Personas entitled to any responsibility of any kind for any ad published or its legitimacy, or the accuracy of users' personal data. Each user agrees to be the only person responsible for the ads they publish.
Users accept any risk associated to contacting other users. By no means will Buscamos Personas be responsible for any damage that users may have suffered due to the achievement or non achievement of these contacts.
Buscamos Personas recommends having a prudent and common sense attitude when contacting other users. Users must bear in mind the risks associated to contacting minors or people with false identity. Buscamos Personas will NOT be responsible for the information users provide.
In case one or more users or third parties may claim or take any kind of legal actions against one another, or other users, all and each one of the users involved must exclude Buscamos Personas and its directors, managers, employees, agents, representatives, and authorities of any responsibility.
09 - Services Reach
This agreement has no society, mandate, franchise, or labor relation character between Buscamos Personas and its users. Users agree that Buscamos Personas holds no responsibility for any action nor has any control on the accuracy of the ads published. Buscamos Personas does not guarantee users will have total success in the publication of their ad. Similarly, Buscamos Personas does not guarantee the accuracy of the ads of third parties that may show in the site, and will not be responsible for any correspondence or agreement users may reach with third parties or other users.
10 – System Failures
Buscamos Personas will hold no responsibility for any damage or loss suffered by users due to any failures in the system, server or the Internet. By no means will Buscamos Personas be responsible for any virus that may affect users' computers as a result of the access, use or examination of its website or any data, files, images, texts or audio transfer. Users will NOT be able to attribute any responsibility to Buscamos Personas nor will they be entitled to any compensation by virtue of any damages for technical difficulties or systems or Internet failure. Buscamos Personas does not guarantee the access and continuation or interruption of its site. The system may eventually be interrupted due to technical difficulties or Internet failure, or any another circumstance unpredictable to Buscamos Personas; in such cases the best effort will be made to re-establish the connection as soon as possible. Buscamos Personas will hold no responsibility for any error or omission in its website.
11 - Rates. Invoicing
Registration is free. When publishing an ad, users must pay a fee based on the type of ad selected to publish the ad. Ads will be on hold for 15 days until payment is made. If no payment is received during this time, ads will be removed from the system.
At any time, Buscamos Personas can modify, change, add, or eliminate the current rates, which will be notified to users. Nevertheless, Buscamos Personas will be able to modify the Rates Policies of its services temporarily due to promotions. These modifications will become effective when publishing the promotion or at the time of announcement.
Buscamos Personas has the right to take extralegal or legal actions to collect the fees that may be owed.

12 - Intellectual Property. Links
The contents of the screens related to the services of Buscamos Personas as well as the programs, databases, networks, and files that allow users to agree and use their account are exclusive property of Buscamos Personas. They are protected by international treaties and laws of intellectual property, trademarks, patents, model, and industrial designs. Any incorrect use and the total or partial reproduction of these contents remain forbidden, unless otherwise specified by Buscamos Personas.
The site may contain links to other websites, which does not indicate they are property or operated by Buscamos Personas. Since Buscamos Personas does not have any control on such sites, it will NOT be responsible for the contents, material, actions and/or services offered by these, nor for any damage or loss caused either directly or indirectly by the utilization of them. The presence of links to other websites does not imply a society, relation, approval or endorsement of Buscamos Personas to the sites and their contents.
13 - Legislation
Buscamos Personas respects your personal data based on the Personal Data Protection Law No 25326 and its Regulation Decree No 1558/2001 of Argentina in its 4º, 5º, 6º, and 10º articles. |
